1. Educational Content Only

Haven ("Haven", "we", "our", "us") provides educational content and EI companionship services. We are not licensed professionals and do not provide medical advice, diagnosis, or treatment. Our services are designed to support your personal growth journey through educational tools and EI-powered conversations.

2. Not a Substitute for Professional Care

Haven is not a substitute for professional services, therapy, or medical treatment. Always consult qualified healthcare providers, licensed professionals, or counselors for:

  • Professional diagnosis and treatment
  • Medical advice and prescriptions
  • Crisis intervention and emergency care
  • Professional therapy and counseling services

3. Age Requirements and COPPA Compliance

  • Haven is intended for users 13 years and older
  • Users under 13 are not permitted to use our service
  • Users 13-17 should have parental consent
  • We comply with COPPA (Children's Online Privacy Protection Act)
  • If we discover a user under 13, we will immediately delete their account and data

4. Account Responsibilities

By creating a Haven account, you agree to:

  • Provide accurate registration information
  • Keep your login credentials secure and confidential
  • Use Haven responsibly and in accordance with these terms
  • Not share content that violates our community guidelines
  • Not use Haven for any illegal or unauthorized purpose
  • Understand this is educational support, not medical treatment
  • Notify us immediately of any unauthorized use of your account

5. Subscription and Payment Terms

  • Haven offers monthly subscription plans ranging from $4.99 to $39.99
  • All payments are processed securely through Stripe
  • Subscriptions automatically renew unless canceled before the next billing cycle
  • You may cancel your subscription at any time through your account settings
  • Refund Policy: Refunds are available within 7 days of initial purchase
  • No refunds for partial subscription periods after the 7-day period
  • Auto-Renewal Notice: Your subscription will automatically renew and charge your payment method unless you cancel before the renewal date
  • Price changes will be communicated 30 days in advance

6. Crisis Support and Emergency Situations

If you are experiencing a crisis, having thoughts of self-harm, or considering suicide, please seek immediate professional help:

  • Emergency Services: Call 911
  • Your Healthcare Provider: Contact your doctor or counselor

Haven includes crisis detection features for user safety. When concerning language is detected, we will provide emergency resources and may share information with emergency services if required by law or to prevent imminent harm.

7. User Content and Intellectual Property

  • Your Content: You retain ownership of your conversation content
  • License to Us: You grant Haven a license to use your conversations (anonymized) for service improvement and EI training
  • Our Content: Haven platform, software, and educational content are owned by Haven EI, LLC
  • Trademarks: Haven, TherapEI, and related marks are trademarks of Haven EI, LLC
  • Prohibited Use: You may not copy, modify, distribute, or reverse engineer our software

8. User Responsibilities and Acknowledgments

By using Haven, you acknowledge and agree that:

  • You understand this is educational content only
  • You will seek professional help for serious concerns
  • You will not rely solely on Haven for treatment
  • You are responsible for your own safety and wellbeing
  • You will not use Haven to harm yourself or others
  • You will not share your account with others
  • You understand that EI conversations are not therapy sessions

9. Prohibited Uses and Community Guidelines

You agree NOT to use Haven for:

  • Illegal activities or encouraging illegal behavior
  • Harassing, threatening, or abusing other users or our staff
  • Sharing false, misleading, or harmful information
  • Attempting to access other users' accounts or data
  • Disrupting or interfering with Haven's services
  • Commercial purposes without written permission
  • Any activity that violates local, state, or federal laws

10. Privacy and Data Protection

Your privacy is important to us. Our data practices include:

  • End-to-end encryption for all conversations
  • Secure data storage with industry-standard protections
  • Limited data sharing only when legally required or for safety
  • Your right to access, correct, and delete your personal data
  • Full details are available in our Privacy Policy
  • We comply with GDPR, CCPA, and COPPA requirements

11. Service Availability and Modifications

  • Haven services are provided "as is" and "as available"
  • We may modify, suspend, or discontinue services at any time with reasonable notice
  • We are not liable for any service interruptions or modifications
  • Scheduled maintenance will be communicated in advance when possible
  • We reserve the right to refuse service to anyone for any lawful reason

12. Limitation of Liability

IMPORTANT: Haven and Haven EI, LLC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from:

  • Your use of or inability to use our services
  • Any content or conduct of third parties
  • Unauthorized access to your account or data
  • Service interruptions or technical problems
  • Any errors or omissions in our educational content

Maximum Liability: Our total liability to you is limited to the amount you paid for Haven services in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Haven, Haven EI, LLC, and our employees from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of Haven services
  • Your violation of these Terms of Service
  • Your violation of any third-party rights
  • Any content you submit or share through Haven

14. Dispute Resolution and Governing Law

  • Continued use of Haven after changes constitutes acceptance
  • If you don't agree to changes, you may cancel your subscription

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Haven regarding your use of our services.
